What is a privacy policy: an explanation from iWeb's IT lawyers

Whenever visiting new sites, the first thing a user sees is an annoying Privacy Policy window.

What is its meaning, is it just an annoying window, or something much more important, iWeb IT lawyers have figured out and are ready to share this valuable information with users.

So that everything is on the shelves, let's start with the terminology. The Privacy Policy is a public agreement with the user, which specifies in detail what personal data the site or application collects, uses, stores, protects and transmits when automatically received, during the use of this resource.

What data can a site or application collect and use? These can be data from registration forms filled out by the user, cookies, settings of the Internet browser (user-agent), etc. The full list of information is specified in the Privacy Policy of a specific site or application.

Why is it so important for a site or application to familiarize the user with its Privacy Policy? Everything here is banal - because it is a legal requirement. Each country has its own regulations on the protection of personal data, therefore the Privacy Policy is developed taking into account the requirements of the laws of the region that covers the site or application, and in some cases also the region of the user.

In Ukraine, this is the Law of Ukraine "On the Protection of Personal Data", in the EU - General Data Protection Regulation (GDPR), in Canada - The Personal Information Protection and Electronic Documents Act (PIPEDA), in the USA the laws vary from state to state, so they usually take the California Consumer Privacy Act (CCPA) as a basis.

Non-compliance with the requirements of the legislation on the protection of personal data is subject to rather strict liability. In order not to receive extremely unpleasant fines, the site or application first of all informs the user about its privacy policy and the use of cookies.

And what are cookies? The well-known free encyclopedia contains the following definition - in computer terminology, a concept used to describe information in the form of text or binary data received from a website on a web server, which is stored by the client, i.e. the browser, and then sent to the same site if it is visited again.

That is, it is a certain file that contains a small amount of information, is stored on the user's device and is subsequently used for the purpose of analysis and performance improvement. In addition, cookies are often used for advertising purposes.

As you can see, the Privacy Policy is not just an annoying window, but an important agreement between the user and the site or application, as well as the result of painstaking work by lawyers when compiling this document.
